It's also a protected right under the first amendment of the US constitution and has been upheld in previous court cases as a protected right. And even if it wasn't it he still should not be held indefinite with out being charged.

Isn't vandalism something that's more permanent? Like spray painting or some such? Side walk chalk washes away with a simple application of water. If Austin was really broke or extremely lazy they could have asked him to stop doing it and then taken a bucket of water to the chalk, no?

Ok...jaywalking.. Maybe a little bit dangerous: people won't necessarily stop for you if you can't quite time your cross right. Common sense is going to tell you you probably don't want to take your chances with a 2500lb vehicle. Noise ordinance is a pita if you live in an area where you are trying to sleep or don't want to hear gangsta rap loud enough to make your ears bleed.. Having lived in places where they don't enforce noise ordinance..you become extremely grateful when you live in a place they do and you have rude and overly obnoxious neighbors. Loitering.. That may not be a big deal but I'm sure it's on the books because some people figure if they can stand around in one place long enough they may be able to harass customers for change. It gets a bit tiresome to be asked again and again bythe same person when you know they are asking everyone and probably don't really need what they are asking for. So..yes..maybe stupid to absolutely enforce it but there are reasons behind it. I'm sure Santa could have washed his vandalism off the side walk and been done with it if they had gone about it in a different manner.
