For real, what about your cell phone?.Even when its turned off it can be turned on by an outside entity and it can record you even if the red record button isn't on...

So the bottom line is you either have to watch everything you say, or people cannot be held accountable to the extent they are, for saying things that might offend others - it's that simple.

And if the conversation is criminal or incriminates, they're going to have to come up with some new form of Miranda rights that this is protected speech. I would understand even if somebody says I'm going to murder somebody and that's captured and they do, they still can't be convicted based on the dialogue.
