So the bottom line is you either have to watch everything you say, or people cannot be held accountable to the extent they are, for saying things that might offend others - it's that simple. And if the conversation is criminal or incriminates, they're going to have to come up with some new form of Miranda rights that this is protected speech. I would understand even if somebody says I'm going to murder somebody and that's captured and they do, they still can't be convicted based on the dialogue.
