Ok so she's an addict (of whatever varieties)....and that means??? That doesn't mean there aren't consequences to actions. Addiction is not an excuse.
That's if he did, in fact, rape her. I'd like to hear his side of the story. Unless there is some sort of proof that he raped her, it's just his story verses hers. I don't see that holding up very well in court after all that happened that night. Seriously, if you were on a jury and you were told of everything that went down that night, could you really take her word for it? After all, they were the only two in the room where it supposedly went down.
That's exactly it. Given the surrounding facts of the case she would have zero credibility if she took the stand and testified about what happened. Throwing a drug and alcohol fueled sex party for your teenage daughter and her friends? Pack that jury full of women and that boy would probably walk out of there a free man.
The behavior in this story is vile. Let's be honest: 'upscale' only means the people that live there have some cash. That has no bearing whatsoever on their morals & behavior. Every time some fuzzy scenario goes down in an 'upscale' area, folk like to play this game on how they're so shocked. Come on man.

You guys just highlighted a HUGE problem in our society. Because she did some other freaky and ill-advised stuff, no one is willing to be sympathetic? Like I said earlier in this thread, it doesn't matter what she did before. She has to consent or it's rape. Sure, the dude should get to tell his side of the story, but your comments show why her side will walk through hell to be sure that as few details of that night get in as possible (outside of the alleged assault). You just set up her lawyer's argument: "Your honor, if the jurors hear about my client's alleged misconduct, they will be irretrievably biased against her and unable to mete out any real justice." And just so it's clear, I'm not accusing either of you of having that messed up attitude. I'm just saying you're telling the truth and it's ugly. Speaking of ugly truth... part of me wonders if this rape cry isn't an attempt to gain some leverage to ease her looming punishment. It wouldn't be the first time someone cried rape to distract from their consensual behavior. But maybe I'm too cynical. It's a catch-22 though. If she's lying (bad), then she wasn't raped (good). But if she's telling the truth and speaking up (good), then she really was assaulted (bad).
But do you charge the daughter as well? I mean she pretty much admitted she was complicit if indeed there was a rape here.
I don't feel sorry that she was "raped" if that's what you want to call it. Normally, I would but not in this situation. I have zero sympathy for a woman - a mother - who created this sick scenario. And if she didn't protest him having sex with her, it's not rape, but even if she did, too bad. I'm a very compassionate person, but I have no compassion for her in this instance.
