Teen killed over loud music

    The whole "you are more likely to be killed by someone you know, than a stranger"
    Seems not to hold much weight these days.

    Very sad, very pointless death.

    I hope that man rots for eternity.

    With all the focus on the Stand Your Ground defense and the potential for abuse, it appears that support for the shooter is crumbling. Both he and the retired policeman who shot the guy in the cinema in Tampa are having some serious problems and there appears to be far more determination to prosecute without the wrong-footing seen in the Trayvon Martin case. Hope justice is done.

    Saw a report on CNN yesterday. All about how Dunn was in Florida on his way to a wedding and even brought his new puppy along.

    All about weddings, puppy dogs, and how Dunn had been hobbled from his injuries in a motorcycle accident when he was young, so he couldn't get away from the "confrontation."

    The guy who died? His representation was reduced to something we all hate: loud music. No face, no humanity, just "loud music" mention after mention.

    Dunn will get away with it. Keep in mind, they're charging him with first degree murder, when obviously it wasn't that. That's so they can say "not guilty".

    Anyone here believe dunn committed first degree murder?

    Media is already selling the verdict.

    Btw, the dialog from Dunn's story (as told in this USA Today report) sounds about as credible as Zimm's "you got a problem? You do now!" story:

    "After the continued threat of 'You're dead, (expletive)!' now the door opens and this young man gets out. And as his head clears the window frame, he says, 'This (expletive)'s going down now!' " Dunn said from the witness stand.

    I'm telling you these guys should've been hollywood screenwriters :roll:

    First degree murder in FL defined, from findlaw.com:

    "Overview of Florida First Degree Murder Laws

    Homicide, the unlawful killing of a human being, includes several degrees of murder and manslaughter under the state laws of Florida. The type of homicide determines the prosecutor's requirements and the potential punishment in the event of a conviction. First degree murder, the most serious of the homicide charges available under Florida law, includes premeditated killings, felony murders, and murders committed during specified drug dealing offenses.

    For a charge of first degree murder based on a premeditated killing, the prosecutor must show the defendant's specific intent to kill. The prosecutor often must establish an advance plan or design formed to carry out the homicide. To establish premeditation, the prosecutor may need to present evidence about the defendant's activities or steps taken to prepare for the killing.

    Florida requires the prosecution of "felony murder," which also leads to a first degree murder charge, when the defendant commits homicide while during the commission of a specified felony or an attempt to carry out a felony. State laws include a list of felonies that qualify a homicide as first degree murder. These felonies include burglary, home-invasion robbery, kidnapping, sexual battery, and many other offenses, including the murder of another person.     Lastly, Florida state laws specify first degree murder for a homicide caused by drug dealing and the unlawful distribution of controlled substances.     Big props to his fiancee (now ex?) who testified against him. She told the truth. Said he never said in the car after the shooting that he was scared or felt threatened, despite him testifying that he did. She said he said he hated that music. If I was a juror, her testimony would be first-hand irrefutable proof in my eyes. She could have easily covered for him.

    This was not a justfiable homicide!!!

    This jury cannot still be out after 27 damn hours!!! Why so much debate? Homicide is defined as the unlawful killing of another with malice aforethought. Was this homicide justified?
    Convict him of Second Degree Homicide if there can be no unanimous consensus on First Degree and he gets 25 minimum plus 60 years for the First Degree Attempted Homicide of the other three brothas in the truck (20 years per attempt).

    Convict him of Second Degree Homicide if there can be no unanimous consensus on First Degree and he gets at LEAST 25 years (mandatory minimum) plus 60 years for the First Degree Attempted Homicides of the other three brothas in the truck (20 years per attempt).

    Jury just reached a verdict on four of the five counts. Count one, first degree murder, is where they are hung up. Judge will send them back to deliberate for a few hours.

    I don't understand why the jury is so indecisive on the MURDER charge. He took a life of a YOUNG TEENAGE BOY who was ONLY 17. Sure, the boy was a smart-a** -foul-mouth, and sure he probably deserved to be disciplined. BUT TO SHOOT 10 ROUNDS AT A CAR FULL OF TEENAGERS??? Surely this OLDER MAN must have known that there was even a slight possibility that one of those bullets could have KILLED or PERMANENTLY DISABLED any ONE OR ALL OF THE KIDS IN THE CAR... By the sheer grace of God, the other boys in the car were fortunate enough to have their lives spared and come out seemingly unharmed... That 46 YO "MAN," being the "ADULT," should have just pulled out and parked elsewhere.

    I don't' believe his claim of "self defense"... Especially considering his OWN FIANCÉ testified that he NEVER MENTIONED FEELING THREATENED or ANYTHING ABOUT SEEING A GUN... If he felt so afraid for his life, why not call the police and tell them that he was attacked and give a description of the car?? Why not scream for help?? Even if it was self defense, why the need for CONTINUAL SHOOTING?? Besides, he must have known there was a possibility that at least one of those boys could have been hurt --> after all, as he claimed, he "thought he saw the boy (Davis) reaching down for what looked like 4 inches of a barrel of a gun." If he saw so much, I'm sure he should have also been able to see BLOOD, SHATTERED WINDOWS, and even HEARD THE SCREAMING...

    Also, PRACTICALLY speaking, if you had even the SLIGHTEST INCLINATION that someone was aiming a gun at you... Wouldn't your first instinct be to GET THE HECK OUT OF THERE?? ==>> why take the TIME to:: 1) LOOK AWAY TO REACH INTO YOUR GLOVE COMPARTMENT, 2) FUMBLE AROUND TO FIND YOUR GUN, 3) PICK IT UP & HOLD IT CORRECTLY, 4) POSITION YOURSELF TO AIM & then, 5) SHOOT.... NOT 1, NOT 2, NOT EVEN 5, BUT 10 **TEN** TIMES?! If the "thugs" were really aiming a gun at him and wanting to kill him, WOULDN'T THEY ALREADY HAVE SHOT HIM BEFORE HE EVEN GOT AROUND TO OPENING HIS GLOVE COMPARTMENT??

    .....Just a general statement: I'm sure he thinks everyone who listens to rap is a "thug." I consider myself a stereo-head & listen to all sorts of music, and I don't mind some rap. I am not a thug, I've never smoked and I don't have grills, tattoos, or illegitimate children. I'm a south Asian female doctoral student (clearly this was more than just “CRAP RAP”)... ****RAP to him may be CRAP, BUT MURDER to me is MURDER!!!****

    I truly hate the Florida prosecution system, why the fuck do these people keep charging these assholes with crimes that won't stick. Murder 1 over Murder 2? Really? Please someone with a legal background chime in and let us know if this feasible

    Just one more grim reminder that it's open season on young black males who are deemed "public enemies number one" in the minds of many in this country. It is extremely dangerous for a black male to simply just exist. If he is not terminated by others outside of his race, he is extinguished by those of his own race. What is the solution to this societal problem?

    Reps for this. Black men are being used for target practice. I can't even genuinely sit here and say this shit might not happen to me or you. All it needs is a gun wielding, axe to grind mofo to say they were afraid and threatened by the big, black boogie monster and they killed said monster in self defense and paint the black person as the vilest element of society and voila, they walk out of court free of murder. If you are black in Florida watch your back, be extra careful and vigilant, on the real. The lives of the gators in the swamps have more value down there than us mere ashy niggers. SMH.

    I feel you, but there is a law in FL that says if you are convicted of firing a gun in commencement of a felony you get a min of 20 years, and dunn got convicted of three counts of it. I just hope his sentences run consecutively.

    But here's the thing that gets me if those other kids weren't in the car dude would have gotten away with killing the unarmed kid who was no threat to him?
    Seriously what the fuck? It's like they punished dude for not killing the other three. I'm glad he's going to jail but this further proof our lives don't matter for shit in this "justice" system. I hate to say it like this but I thank God I don't live in the south right now. NYC ain't no picnic but I am not constantly on guard like I would be in the south and I would NEVER feel comfortable dating ww out there. I know most people don't care but all you need is one piece of shit with an axe to grind to get upset and he can take me away from my loved ones with zero consequences.
