Man ordered to pay $65K in child support for kid who isn’t his

    A friend of a friend is trying to help this guy with his legal defence. Let this be another warning to the men here, the law is FAR from perfect, protect yourselves at all times... "His ex-girlfriend’s attorney, Carel Stith, claimed that money was taken out of Cornejo’s paycheck several years ago and he didn’t contest it, and that in itself can satisfy a court argument that he should have handled the matter long ago."

    There can be consequences, even if you don’t do anything,” Stith told local news.

    OMG! How can such a rule be allowed? No part of that is fair. I hope for this guy's sake that common-sense prevails and another judge will rescue hm.

    This particular case might (but probably won't) get adjudicated fairly because of the media attention, but there is little chance that the law itself gets changed. If any law maker attempted to change this law, the children's advocacy groups would cry bloody murder.

    If I were him I'd hire a private investigator to track down the real father, it would probably be cheaper than paying the 65 grand.

    I saw this the other day and found it incredulous... my thoughts were that he will win, how can he not. It's simply too ludicrous in all its details.

    How can he track the real father? His own name is on the birth certificate right? So even if he does find him, the bio dad can say its not his name on there.

    The outcome won't change with another judge.

    This is actually the law in Texas.


    It's also common in many states to order a person who is not a biological parent to pay support if they have acted as the parent of a child for a significant period of time. The courts will treat you as the biological parent even if you can prove that you aren't if you've been supporting the child.

    Brother Loki is correct when he says to protect yourself. Make sure that you have a DNA test before your name gets put on a birth certificate if there's any doubt that you are the father. If you find out that you aren't the biological father, you need to take immediate legal action.

    I don't know I'm just throwing stuff out there. I figure since the law is only concerned with getting support for the child, so if the non-daddy could find the real daddy the court might be willing to shift the burden to him instead.

    As often is the case Thump, when it comes to the law, it is not always straight forward. There have been cases where the biological father was located and stepped up to take over the support payments, and the non-biological party was let off of the child support hook, however, those cases are far and few between. Once a man has been named as the responsible party, all the responsibility falls on him to prove otherwise, before any payments or notifications can take place, kind of the opposite of innocent until proven guilty, when it comes to support payments, men are guilty until proven innocent, and even then there are multiple legal hurdles.
