Rapist is told he could have contracted HIV from his victim as he is jailed for five years

He entered the woman's home and raped her
Fears over contracting disease are his 'own fault' said judge

    By Sam Webb

A man who has been jailed for raping a woman has been told that he could have contracted HIV as a result of the attack he inflicted upon his victim.

Richard Thomas, 27, collapsed when police informed him about the woman's medical status and is still waiting to hear if he has contracted the incurable virus.

Thomas, of Leigh in Greater Manchester, knew the woman and was aware that she has another illness but had not known about the HIV.

The court heard he was shocked when he was told and asked to be taken to hospital, Liverpool Crown Court heard.

He had let himself into her home in the middle of the night and she awoke to find him raping her.

'She froze and no words were exchanged. He pulled up his shorts and left,' said Harry Pepper, prosecuting.

'He was arrested and interviewed and said he had been drinking heavily, taken cocaine and ecstasy and could not recall the incident,' he added.

His barrister, Virginia Hayton, said that he still cannot recall the attack but when told about it he said that the woman 'would not lie, she tells the truth. If she says I have done it, I have done it'.

Jailing Thomas for five years and four months Judge Mark Brown said that he had committed 'this dreadful offence' while she lay asleep, having taken a sleeping tablet, and it had left her distressed and anxious.

He also ordered him to sign the Sex Offenders' Register for life. Thomas pleaded guilty to raping the woman on July 20 this year.

Miss Hayton said that Thomas, who has previous convictions but none for sexual offences, is 'remorseful' and 'cannot understand why he did it and it is troubling him'.

She said that he started using cannabis at the age of nine, drinking heavily at the age of 11, became addicted to ecstasy and cocaine at 13 and was put in care the following year.

He has been trying to contact his family but they want nothing to do with him and he will now be away from his partner and their young daughter and his two other older daughters from previous relationships.

Miss Hayton told the court that Thomas will not find out the result of his HIV test until Friday and has had the worry of the outcome hanging over him.

'It is his own fault, if he had not committed this offence he would not have placed himself in this position"

To think that such a person can actually have children... its scary.

I wouldn't shed a tear if he catches it and dies while in jail. If his victim has to suffer from all the trauma he caused, so should he.

He is only getting five years. What if he gets HIV and gets out and starts raping again?

Crap, just now realized that, @ only 5 years. That's not long AT ALL! Well hopefully if he has contracted it he may die before then.

But your point is scary, AlmostThere - he may rape again and destroy and 'murder' so many other women. God what a scumbag, here on earth only to cause death and mayhem.

I'm with all of you on the he gets what he deserves regarding a positive HIV status for raping a woman.
So please don't think I'm condoning his behavior. I am not.

But I read the stuff from when he was nine and I can only think he was just a child. And a small and lost one at that it would seem.
These are all decisions he made in the course of his life that got him to this point.

I just wonder. If he was drinking and using at such a young age..
It must have been to dull a pain or a hurt or anger. Something.
If someone had been there for him then..
    A positive role model..
    A caring hand
    A listening ear

His life, and the life of everyone effected by the horrible choices he made might be different today.
And I really feel sad that as a nine year old, he felt he had to smoke pot and that he was drinking heavily by the age of 11

He was a child. A child. No child can make reasonable decisions at the age of 9

    That's why you have parents.

Going to prison, he is probably going to get much better healthcare than if he was free. At taxpayers expense of course.

5 years is letting him off easy. 25 years would be suffice. 10 years minimum.

I recall a story over 20 years ago about a rape incident in Atlantic City, NJ. A man accosted a woman. He proceeded to assault her. The woman told the rapist that she was HIV positive. The rapist didn't believe her and he continued his assault. This man really fucked up. And he still has hell to look forward to.

I can see your sympathy for the '9 yr old' but he was 27 when he did it. At some point into adulthood, you know you are accountable for your criminal behavior. He pretended to not know what he did, but he was sober enough to break in, and rape a woman and leave. I would save your sympathy for someone who really deserves it.

    Bliss, I think you misunderstand.
My sympathy for his suffering doesn't take away from anyone else needing sympathy for suffering.
Of course we are all held accountable for our life choices. You can't have it any other way. Even if we never see it the worst offenders are held accountable in one way or another eventually. It doesn't matter your belief system or who you pray to. Whether its that you live through limitless lifetimes and suffer the cause and effects of karma created in previous lifetimes or you suffer through the second death and burn in a lake of fire..
We are all held accountable in one way or another.

I honestly believe that the inherent being of all beings is good. and compassionate. Whether you want to say that we are led astray by evil temptations or we forget that we start clean but get dirty and can't see the wholeness, the idea is the same.

People do hurtful things because they hurt and its human nature to lash out when in pain.
Again, I'm not excusing his behavior or the suffering he has caused untold people.

None of us is innocent. Therefore none of us can know another's demons and our own personal hells.
If that is the case for all people..
Then perhaps compassion and empathy for all who suffer could go a lot further than judgement and hatred.

Of course we fall. We forget. We get wrapped up in human emotion. It's easy to hate him for what he did.
But think of how the world would change if instead of rushing to punishment and hatred first we could offer empathy and forgiveness first.
Isn't that the essential teaching of Christ Jesus?
