Harvey Updyke, the man allegedly responsible for the poisoning of the Toomer’s Corner oak trees at Auburn University in Alabama, has been arrested, according to reports.

Updyke, 62, has been reportedly charged with criminal mischief, a Class C felony that could cost him up to 10 years in prison.

He is being held on $50,000 bail.

Auburn University says it’s historic, 130-year-old Toomer’s Corner oak trees were poisoned with an herbicide called Spike 80DF, or tebuthiuron. It’s a tradition at Auburn University to toilet paper the famous oaks after a Tigers football win but now that tradition may have come to an end, says the University.

Spike 80DF is an herbicide used to intentionally kill trees and the university says the chemical was “deliberately applied in lethal amounts to the soil” around the Toomer’s Corner oaks. The university says there is “little chance” to save the trees.

On January 27, someone called into The Paul Finebaum radio show based in Alabama, claiming to have doused the trees in herbicide.

The university took soil samples the next day and tested them. The tests turned up a “very lethal dose” of the poison.

“We will take every step we can to save the Toomer’s oaks, which have been the home of countless celebrations and a symbol of the Auburn spirit for generations of Auburn students, fans, alumni and the community,” University President Jay Gogue said in a statement. In an attempt to remove the poison, the university will dig around the trees and use charcoal to block the spread of the chemical.

He'll probably get nothing more than a slap on the wrist. I'd be surprised if he even got probation.

Fool called in the radio station and let everyone know he committed the crime.

That reminds me of a fugitive a couple years ago on the FBI's most wanted list. There was a big monetary reward for anyone who helped bringing him in and upon finding out,the fool walks in to the nearest police station to turn himself in,thinking he'd get the money...

ROFL, from the looks of this dude not much else has meaning in life to him, so this must have been his greatest moment, he couldn't help his stupidity.

    POS.

Max fine, give him a couple of years...b/c what if a family decided to picnic under or near there.

Recently, a family lost their baby when a rodent(beaver)? removal specialist placed the poison too near the home and the fumes killed the homeowner's child.

Oh yeah, make him plant a tree every month for 5 yrs as part of his punishment.

I can tell he's guilty, by his lips...

What other guilty person do we know who made his lips the same way...?

One responder said it best about individuals like this, pretty much nailed it on the head about bigots.

The irony is ignorant, bigoted individuals don't realize this no matter how much it is highlighted. Its simply mind boggling how blinded people can be by their hatred and preconceived notions.

Maybe this father felt his daughter was too young at 12, maybe he is a bigot, only he knows for sure.

The young kids at school are probably laughing their asses off at the parents, this man hasn't seen anything yet if one day his daughter goes off to college, what will he do then I wonder. :)

LOL, nah, MikesAndy just posted that link from that recent story in Alabama, same state as this tree poisoning idiot. Just shows how screwed up some people can be in their mindset.

Notice how both of these stories are from Alabama and both involve hate and irrational behavior, one targeting a 150 year old tree, another young children, hmmm. Yet it is 2011.

It does not belong in this thread - it wasnt about Alabama per se, nor was it about racism etc... Poisoning trees has nothing to do w hatred towards ww/bm unions The dude didnt give a shit about that when he poisoned he trees.
We all know about this type of hatred. If you want to discuss it - put it where it belongs and stop derailing this thread.

Not that this thread will last for long..

Pretty much, Kunoichi, this man didn't even attend the University of Alabama and committed such a foolish act against something that had a lot of meaning to Auburn University, all over his hatred of Auburn football and Auburn being National Champions, smh.

As someone who loves history and historical items, hate to see such desecration. Fully agree about the part of making him plant trees as well.

I apologize, FG. I guess I should have created a separate thread about that topic even though I was a few days late. Anyways, we can't read the guys mind so we don't know fully what his intentions were. I'm sure that he does know that the majority of the players in the NFL/football in general are African Americans. Maybe that had something to do with it and he came up with the idea for poisoning trees, because what do you think the purpose of a tree is? A tree takes in carbon dioxide and releases it back out into the atmosphere as oxygen.
