If both parties agree, the judge isn't going to argue Andrae. It's divorce court, not criminal court, judges don't impose their own judgements if the parties have agreed. Why would they, if he's willing to give it, and she's willing to take it, there's nothing left for the judge to do by sign off on it.

If the parties agree on that, then he just signs off on whatever they decide. A judge determines alimony if one party wants it and the other doesn't want to pay. Essentially anything the two parties agree to prior to the final divorce hearing, the judge just signs off on. A judge really only makes decisions regarding the items you cannot agree on, at least that's the case in Oklahoma and a few other states that I know of. I assume it's that way pretty much everywhere, but laws probably vary somewhat from state to state. But in general if the two parties in a divorce aren't arguing over something, the judge isn't really going to be involved in making a decision on that, he's only concerned with the things you can't come to an agreement on. Mediation has become really common in divorces recently for precisely that reason. Couples meet with their attorneys and a mediator to try to work out an agreement on as much as possible before it goes before a judge. Supposedly it speeds things up and requires less time before a judge. It's also supposed to be less expensive to the parties involved, as in theory it's quicker and therefore everyone pays out less in attorney's fees.
