Roman Polanski

    What is your take on Roman Polanski issue? Should he be prosecuted to the fullest extent of the Law here or should he be forgiven since the woman involved in this case has forgiven him and moved on?

    LOL...You're hilarious.

    As for the question, they should prosecute him regardless of the victim's feelings. He alleges it was consensual, however a 13 year old doesn't have the capacity to give consent. The man is a rapist and they need to relocate him to a 10 x 8 cell.

    Sexual abuse at a person under age is a criminal action of public interest. The opinion of the victim is not important. It concerns rather the clearing-up of the case and the prevention from repetition acts. Distribution is completely correct.
     
  5. Here are the facts. On one hand;

    1) First incident;
    2) Unrepeated in 30 years;
    3) Other party has moved on.

    On the other:

    1) Other party was 13, he was an adult.

    He cannot be punished as severely as we would punish someone who committed the offence last year. He hasn't (as far as we know) re-offended and thus we must assume his record SINCE then is innocent until proven otherwise. The defendant claims the other party did not voice any objection at the time. Her dispassionate reply, in which she does not exhibit anger nor any desire for retribution, lends weight to the defendants claim that the coupling was, indeed, without objection on her part.

    However he nonetheless broke the law, and should not go unpunished. In view of the above and his age, 4 weeks in jail. If the Swiss authorities detain him for that length of time awaiting the decision to extradite, that should be considered as time served.

    I'll end this post on cynical note. This case is a good example of the glaring distance between the law and justice, but for reasons I've left unmentioned.

    I dont believe there is any justice to be served by imprisoning him. But there is equality in sentencing that should be administered. If memory serves, he pled guilty and fled before sentencing?

    If it had been my 13 yo niece, I would be pissed. But I have to remind myself that when I was 13 I had a GI boyfriend, so it is kinda hard for me to judge too harshly.

    So if you have money and can run away for 30 years or so til everyone forgets it's like you never committed a crime??!! If you murdered someone and eluded the authorities, the murdered person really wouldn't be dead after all.

    There are reasons there are laws against people who do things to children. Children don't have the capacity to make decisions at 13 like they do at say 25. It puts them more at risk of being taken advantage.

    seriously, how many future convicts willingly pack 20 tubes of KY, cherry lip gloss, and a long blond wig, for their stay at 'club fed?'

    When I heard that one of the directors of the petition was Woody Allen who had sex with a daughter of his longtime girlfriend and later married her. That is sick indeed. Polanski should be in jail for a long time.

    A crime like this I don't think it has a statue of limitation. If Polanski goes to jail he won't survive it.


    What would you do if you were a judge faced with this case?

    How would you punish 76 yo Polanski and what is the best way to punish him?
    How would you make him pay for the crime he comitted 30+ yrs ago and send a message to criminals?
    How can a society benefit from this case?
    Would you consider the fact that Polanski had suffered in Nazi concentration camp as a child, lost his mother in the camp, lost his wife and unborn child to murder prior to committing this heinous crime?
    Would you take in account Polanski's numerous charity, the fact that the lady has forgiven him, and some say he has been rehabilitated?

    Be a Judge and preside on this case.....

    Make him serve one year, then put him on house arrest for another year.

    According to the victim, she repeatedly told him no.

    He plead guilty to sex with a minor, but most evidence points toward it being forceable rape, both vaginally and anally, of a 13-year-old girl.

    She says she had to fake an asthma attack to get away.

    His memoir recounts several other sexual encounters he had with girls under the age of 16 in places where that was legal, although there's no evidence that those encounters were forced.

    I seriously doubt it.
    I think she "forgave" him , officially - just so that she does not have to rip open the wounds again.

    C'mon people, get real - she was even sodomized, at 13 - in her heart, I bet you she has not forgotten or moved on...
    Forgive is something you do for youself, not the perp..

    She has most like tried very hard to forget the incident as much as she can, and getting involved would mean she has to face it again.. a thing we all should understand she does not want to.
    The guy has been involed in a lot of shady stuff - he had it comming.

    Not prosecuting him would be sending a horrifying messages out there to people that does similar things and also to the victim.

    What he went through was truly horrible, but taking that into account for a crime he committed is ludacris - should we do that to all criminals, most of them would be out walking....
    Nah, you committ a crime, your past doenst have anything to do with it - whatsoever... you should pay your dues, period.

    In this case, given the lecngt of time that has passed and his age... maybe some time could be served in a "luxury prison" such as Martha and then as home arrest..
    I dont know and I really dont care - but he has to face it and it cant be thrown out - a rape-victim has in the vast majority of the cases a life that is ruined forever and will never be the same, ever.

    For those of you saying Home arrest or luxury prison- Polanski is a film director: he can write at home, can stage and direct some scene at his home and direct other scenes with advanced technology from the luxury of his couch, therefore, he will not lose that much. Is he really punished, then?
    What is the best way to punish this 76 yo man?

    Good question - ut I think you acctually can put such stipulations on the time served that you cant engage in your work - I think that has been done to several house arrestees if Im not misstaken....
    ?

    Oh, and Jaybee - did it ever occur to you I spelled Ludacris like that on purpose? but thanks for the English lesson LOL
