    Off duty, no probable cause. What does he need to obey any commands for?

    "..Officer Amber Guyger told the authorities she was returning from a 15 hour shift when she had mistaken her neighbor's four floor apartment at South Side Flats, in Dallas, for her own home on the third floor on Thursday.

    Entering the darkened apartment, the door to which she has since claimed was slightly ajar, she told police she mistook 26-year-old resident Botham Jean for a burglar and shot him in the chest. He was later transported to hospital where he was pronounced dead.

    The affidavit says Guyger only realized she was in the wrong apartment during the 911 call when she turned on the light. It states that Guyger's apartment was directly below Jean's and the apartment layouts and exterior hallways were nearly identical.

    Investigator David Armstrong of the Texas Rangers said Guyger gained access to her neighbor's apartment because, when she inserted her key in his door, it opened because it had been slightly ajar.

    He says Guyger said the person ignored her verbal commands and she fired twice. One struck Jean in the chest and he later died.

    Dallas Police Association President Mike Matas says that three different investigators told him to warn Guyger to stay away from her apartment for her own safety, Fox 4 Dallas reports..."

    So she didn't turn the lights on UNTIL she was mid phone call? So a police officer isn't going to do a sweep of her own apartment to make sure there's nobody else in there? So shes not going to check if the brother was stipp responsive after she fired? And they are trying so hard to let people know about her 15 hour shift.

    She obviously murdered dude on purpose, the question is WHY and how did she think she was gonna get away with it??


    Even if you buy her story she went to the wrong apartment,(not believable), how does she expect us to believe dude conveniently left his door unlocked??
    I'm not for surveillance cams all over the place in public spaces, but damn I wish they had a cam on that hallway to really see what happened when she approached his door.

    If they were sleeping together, there's going to be evidence somewhere.

    Well if they do their due diligence and go through their phones or his phone at least. All it takes is one text message and she's done.
    If a pre existing relationship is established her whole story turns to shit but I have a feeling they're gonna pull the word of an officer is only second to God bs.
    I guarantee they're going to say she was on duty since she had her uniform on and even if it was an accidental death she's gonna get off Scott free because she can say she believes everything happened during the commission of a crime and she "feared for her life"
    This is going to end up exactly like Oklahoma and she's gonna get transfered to another department teaching other officers how to deal with this exact situation.
    The more I think about it no jury in this country would ever convict this white woman especially if her defense puts a pic of her next to him.
    "She was just doing her job. Imagine if you came home to see a man like this in your home after working a double shift. You'd be scared too especially if he didn't respond to commands"
    Once the big scary black man trope enters the consciousness game over.
    A white jury in Texas will acquit her before closing arguments.

    DPD will have an even bigger shit show if they pull the "she was on duty" defense as DPD statement says she had just gotten off/worked a full shift/shift ended. That language, as well as her simply going home, says she was off duty and for them essentially retract that statement will prove further guilt as well as a cover up. This while thing has been a mess from the go so I don't think even DPD will insult the publics intelligence THAT much when we have receipts straight from their mouth and blog.
    Ive heard DPD isn't a very good police department anyway though.

    Well here in New York the minute an officer acts in the capacity of an officer they are on duty. So you could be a cop witnessing someone running from a store with some money if you decide to give chase you're officially on duty. So they could argue when she started giving commands she was on duty. If it even gets to a jury they have to work within the confines of the law so if the law says she's on duty the moment she says she's on duty everything after that is her acting as an officer. Its wildly fucked up and creates and even deeper divide but those are the rules.

    Yeah, I don't see any kind of way she's not going to prison. This was like the worst shoot ever, and her excuse is just stupid.
    It would be like walking up to someone's car, seeing someone in the driver's seat and shooting them, then saying," Oh, I thought that was MY car and the man inside was trying to steal it."

    That's not the kind of cop most police departments want to defend too hard, although it looks like her police union put up bail money quick.
